Guest Terms of Use

You (collectively, "Guest") and Eric Lesar, an individual doing business as Le Dome ("Host"), agree to these Guest Terms of Use ("GTUs") governing your use of the Host's booking site and the short-term rental premises — a private A-frame cabin in Arnold, California (Blue Lake Springs community) (the "Premises"). By checking the acceptance box and completing your booking, you accept and agree to be bound by these terms on behalf of yourself and all members of your party.

1. The Accommodations

Host provides access to the Premises and its amenities, which include: a keypad door lock, central heat and A/C; linens and bath towels; a full kitchen; televisions with streaming and a projector; WiFi; a private cedar sauna, private hot tub, fire pit, and propane BBQ; and access to the Blue Lake Springs community pool and tennis courts (availability and pricing per community rules). Amenities and floor plan may differ slightly from photographs, and the Accommodations shall not be deemed deficient on that basis. Guest must not remove Amenities from the Premises and authorizes Host to charge Guest's card to repair or replace any Amenity found missing or damaged.

2. Guest's Agreement

Guest agrees to pay all charges specified at booking, to conduct themselves in an orderly and lawful manner, and to comply with the Guest Policies below. Use of a name other than the Guest's true legal name is grounds for immediate cancellation.

3. Occupancy Term & No Tenancy

This booking grants Guest a limited, non-transferable license to occupy the Premises for the reserved dates only. It does not create a tenancy, lease, or any residency rights under California landlord-tenant law, and Guest waives any claim to such rights. Occupancy ends at the stated check-out time. A Guest who remains on the Premises past check-out without Host's written approval is an unauthorized holdover and unlawful occupant, subject to the holdover charge in the Fee Schedule plus any resulting costs, and Host may take all lawful steps to recover possession of the Premises.

4. Release, Indemnity & Assumption of Risk

Guest's use of any pool, hot tub, spa, sauna, fire pit, or other amenity is at Guest's sole risk. Guest must inspect the Accommodations immediately on check-in and give immediate notice of any deficiency; failure to do so waives related claims and Guest assumes the risk of any resulting injury or damage. Guest is solely responsible for their own personal property, which Host does not insure. Guest is responsible for all damage during the stay and, to the maximum extent permitted by law, agrees to release, indemnify, defend, and hold Host and the Host Parties harmless from all claims, demands, and causes of action (including attorneys' fees) arising on, in, or near the Premises or out of the condition of the Accommodations or Amenities. To the extent Guest carries insurance covering such losses, Guest waives rights of subrogation against Host.

5. General Provisions

Guest authorizes Host to charge the card on file without a signed slip; an electronic copy of this agreement and record of assent serves as an original authorization, irrevocable until 90 days after checkout. This agreement is the entire agreement between the parties, is severable, and is governed by the laws of the State of California. Any dispute shall be resolved by a bench trial in Calaveras County, California; the parties knowingly waive their rights to a jury trial and to participate in any class action. The prevailing party in any action is entitled to reasonable attorneys' fees.

Guest Policies, Terms & Procedures

Payment. The full rental amount, fees, and taxes are charged at the time of booking. Credit Card Charges. Guest authorizes Host to charge the card on file for damages, extraordinary cleaning, unauthorized early check-in or late check-out, and the fees below, determined in Host's sole discretion, and waives chargeback rights for charges permitted under this agreement.

Cancellation: Full refund 30+ days before check-in. If booked fewer than 30 days out, full refund within 24 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in; no refund thereafter.

House rules: No unlawful or commercial use (remote work is fine). No alterations to the cabin or devices. Maximum occupancy 8 guests; no parties or events without written approval. Quiet hours 11:00 PM–8:00 AM — a second noise complaint ends the stay without refund. Observe all Blue Lake Springs community rules, including driveway-only parking. Guest pays all costs if law enforcement is called for an issue involving the Guest. No pets (including service animals) unless pre-approved in writing. No smoking or vaping anywhere on the property, including the cabin and sauna. Check-in 4:00 PM, check-out 11:00 AM unless otherwise arranged. Return all keys/fobs at check-out.

Fee Schedule

• Unauthorized late check-out: $25/hour
• Smoking: $300
• Extraordinary cleaning: $150/hour
• Unauthorized pets: $200
• Broken/missing amenities: greater of $100 or actual replacement cost
• Missing key/fob/guest card: $100 each
• Unauthorized holdover past check-out: $750/night (or portion thereof)

Credit Card Authorization & Acceptance

By checking the acceptance box and completing payment, Guest authorizes Host to charge the card on file for the booking rent and for any damages, missing/broken amenities, extraordinary cleaning, and fees specified above, and consents to later email authorizations having the same effect as a wet-ink signature. Guest waives chargeback rights for charges permitted under this agreement. Checking the box and completing payment constitutes the Guest's electronic signature under the federal E-SIGN Act and California's UETA, recorded with the Guest's name, email, and a timestamp at the time of booking.
